Please read these Terms of Service ("Terms") carefully before using PliantAI. These Terms constitute a legally binding agreement between you ("you" or "User") and Pliant Labs LLC ("Pliant," "Company," "we," "our," or "us"), governing your access to and use of the PliantAI platform, including all associated websites, applications, features, content, and services (collectively, the "Service"). By creating an account, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund Policy, each of which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.
1. Eligibility
You must be at least 13 years of age to create an account or use the Service. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. Certain features of the Service, including but not limited to content designated as NSFW or age-restricted, are available only to users who are at least 18 years of age. By enabling or accessing age-restricted features, you represent and warrant that you are at least 18 years old. We reserve the right to request verification of age at any time and to suspend or terminate accounts where age eligibility cannot be confirmed.
2. Account Registration and Security
2.1 Account Creation
To access certain features of the Service, you must register for an account by providing accurate, current, and complete information, including your name, email address, username, date of birth, and a password. You agree to update your account information promptly to keep it accurate and complete.
2.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You agree to immediately notify us at support@pliant.bot if you become aware of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials. We strongly recommend enabling two-factor authentication where available.
2.3 Account Restrictions
You may not create more than one account per individual. You may not assign, transfer, sell, or share your account or account credentials with any third party. Accounts created by automated means (bots, scripts, or similar mechanisms) are prohibited and will be terminated immediately.
3. Description of the Service
PliantAI is an artificial intelligence-powered conversational platform that provides users with AI-generated text responses, content generation, image generation, voice interactions, group chat capabilities, and related features. The Service is offered in both free and premium subscription tiers, each providing varying levels of access, model capabilities, and features. The specific features, models, and capabilities available under each tier may change at our discretion. We reserve the right to modify, suspend, discontinue, or introduce new features or services at any time, with or without notice.
4. User Content and Conduct
4.1 Your Content
You may provide input to the Service in the form of text, images, files, voice recordings, and other materials ("Input"), and you may receive output generated by the Service based on your Input ("Output"). Input and Output are collectively referred to as "Content." You retain ownership of your Input. To the extent permitted by applicable law, Pliant assigns to you all right, title, and interest in Output generated specifically in response to your Input. You acknowledge that due to the nature of artificial intelligence, Output may not be unique, and other users may receive similar or identical Output.
4.2 License to Pliant
By submitting Input to the Service, you grant Pliant a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, and process your Input solely for the purposes of operating, maintaining, and improving the Service, including training and improving our AI models, unless you opt out of model improvement through your account settings. Opting out of model improvement will not affect the functionality of the Service available to you.
4.3 Prohibited Conduct
You agree that you will not use the Service to:
- Generate, upload, transmit, or distribute content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
- Generate content that exploits, harms, or attempts to exploit or harm minors in any way, including the generation of child sexual abuse material (CSAM) or any sexualized depictions of minors;
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity;
- Engage in any activity that constitutes fraud, phishing, scamming, or social engineering;
- Generate spam, unsolicited communications, or content designed for mass distribution;
- Attempt to circumvent, disable, or otherwise interfere with safety filters, content moderation systems, rate limiting, or any other security or protective features of the Service;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, models, or underlying technology of the Service;
- Use automated systems, scripts, bots, crawlers, scrapers, or any other automated means to access the Service or extract data therefrom without prior written authorization;
- Use the Service to develop, train, or improve any competing AI model, product, or service;
- Interfere with, disrupt, or create an undue burden on the Service, its servers, or the networks connected thereto;
- Use the Service to generate content that infringes upon any third party's intellectual property rights, including copyrights, trademarks, or trade secrets;
- Use the Service to generate professional advice (including medical, legal, financial, or therapeutic advice) and represent it as authoritative professional guidance; or
- Violate any applicable local, state, national, or international law or regulation.
5. AI-Generated Content Disclaimer
The Output generated by PliantAI is produced by artificial intelligence systems and is provided on an "as-is" basis for informational and entertainment purposes only. You expressly acknowledge and agree that:
- AI-generated Output may contain inaccuracies, errors, omissions, biases, or hallucinated information;
- Output should not be relied upon as a substitute for professional advice of any kind, including but not limited to medical, legal, financial, psychological, or safety-critical advice;
- You are solely responsible for evaluating, verifying, and assuming all risks associated with the use of any Output;
- We make no representations or warranties regarding the accuracy, completeness, reliability, suitability, or availability of any Output;
- Similar or identical Output may be generated for multiple users, and Output is not guaranteed to be unique or original; and
- We are not liable for any decisions made or actions taken based on Output generated by the Service.
6. Subscriptions and Payment
6.1 Subscription Plans
PliantAI offers premium subscription plans (currently designated as Plus, Smart, and Pro) that provide enhanced features, model access, and capabilities beyond the free tier. The specific features, pricing, and availability of each plan are described on our Premium page and may be modified at our discretion.
6.2 Billing and Payment
All subscription payments are processed securely through Stripe, our third-party payment processor. By subscribing to a premium plan, you authorize Pliant to charge the applicable subscription fee to your designated payment method on a recurring basis (monthly or annually, as selected by you) until you cancel your subscription. All prices are displayed in U.S. dollars unless otherwise indicated. You are responsible for all applicable taxes.
6.3 Automatic Renewal
Subscriptions automatically renew at the end of each billing cycle unless cancelled by you prior to the renewal date. The renewal charge will be applied to your payment method on file at the then-current subscription rate. We may change subscription pricing at any time, but will provide at least 30 days' notice before any price increase takes effect for existing subscribers.
6.4 All Sales Final
All purchases of subscription plans are final. Once a subscription purchase has been completed and your subscription has been activated, no refunds, credits, or exchanges will be provided for any reason, including but not limited to dissatisfaction with the Service, failure to use the Service, partial use of a billing period, or changes in personal circumstances. 6.5 Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period. No prorated refunds will be issued for the remaining unused portion of any billing period. After the billing period ends, your account will revert to the free tier.
7. Intellectual Property
7.1 Pliant's Intellectual Property
The Service, including but not limited to its software, algorithms, AI models, user interface, design, graphics, logos, trademarks, trade names, service marks, and all other proprietary content and materials (collectively, "Pliant IP"), is owned by or licensed to Pliant Labs LLC and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works based on any Pliant IP without our prior written consent.
7.2 Trademarks
"PliantAI," "Pliant," the Pliant logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Pliant Labs LLC. You may not use such marks without our prior written permission. All other trademarks, service marks, and trade names referenced on the Service are the property of their respective owners.
7.3 Feedback
If you provide us with any feedback, suggestions, improvements, or ideas regarding the Service ("Feedback"), you hereby assign to Pliant all right, title, and interest in such Feedback. Pliant is free to use, disclose, reproduce, license, distribute, and otherwise exploit Feedback without restriction or compensation to you.
8. Content Moderation and Enforcement
We reserve the right, but are not obligated, to monitor, review, filter, moderate, or remove any Content at our sole discretion, including Content that we determine, in our sole judgment, violates these Terms, our policies, or applicable law, or is otherwise objectionable. Our AI moderation systems may automatically flag, filter, or block certain types of Content. We may investigate violations of these Terms and take any action we deem appropriate, including but not limited to issuing warnings, temporarily or permanently suspending accounts, restricting access to features, removing Content, and reporting violations to law enforcement authorities.
9. Account Suspension and Termination
9.1 Termination by Pliant
We reserve the right to suspend, restrict, or terminate your account and access to the Service at any time, with or without cause, and with or without notice, including but not limited to circumstances where we reasonably believe you have violated these Terms or any applicable law, your use of the Service poses a security risk, or continued provision of the Service to you is commercially or legally inadvisable. Users who are suspended will be notified of the reason and duration of their suspension. Permanent suspensions may be appealed by contacting support@pliant.bot.
9.2 Termination by You
You may terminate your account at any time by contacting our support team or through your account settings. Upon termination, your right to access and use the Service ceases immediately, except that if you have an active paid subscription, you will retain access until the end of your current billing period.
9.3 Effect of Termination
Upon termination, we may delete your account data, including all conversations, settings, and personalization data, in accordance with our Privacy Policy. Termination does not relieve you of any obligations incurred prior to termination, including any payment obligations. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and dispute resolution provisions.
10. Third-Party Services
The Service may integrate with or contain links to third-party websites, services, or applications ("Third-Party Services"), including but not limited to Stripe for payment processing. Third-Party Services are governed by their own terms and privacy policies, and we are not responsible for their content, functionality, security, or practices. Your use of Third-Party Services is at your own risk, and you should review the applicable terms and policies before using them.
11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. PLIANT SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, PLIANT MAKES NO WARRANTY THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE OUTPUT OBTAINED THROUGH THE SERVICE WILL BE ACCURATE, COMPLETE, RELIABLE, OR CURRENT; (D) ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED; OR (E) THE SERVICE WILL BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PLIANT LABS LLC, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF PLIANT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO PLIANT FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00). THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify, defend, and hold harmless Pliant Labs LLC, its affiliates, and their respective officers, directors, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and costs) arising out of or relating to: (a) your access to or use of the Service; (b) your Content, including any claim that your Content infringes or misappropriates the rights of any third party; (c) your violation of these Terms or any applicable law or regulation; or (d) your negligence or willful misconduct.
14. Dispute Resolution
14.1 Governing Law
These Terms and any disputes arising out of or relating to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles.
14.2 Informal Resolution
Before initiating any formal dispute resolution proceedings, you agree to first contact us at support@pliant.bot and attempt to resolve the dispute informally for at least thirty (30) days.
14.3 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in the English language, and the arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction. You may opt out of this arbitration provision by notifying us in writing at support@pliant.bot within thirty (30) days of first accepting these Terms.
14.4 Class Action Waiver
YOU AND PLIANT AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. If any court or arbitrator determines that this class action waiver is void or unenforceable for any reason, or that an arbitration can proceed on a class basis, then the arbitration provisions set forth above shall be deemed null and void.
14.5 Exceptions
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
15. General Provisions
15.1 Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service with a new effective date and, where practicable, by sending an email notification to the address associated with your account. Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must cease using the Service and terminate your account.
15.2 Entire Agreement
These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Pliant regarding your use of the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter hereof.
15.3 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
15.4 Waiver
The failure of Pliant to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
15.5 Assignment
You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may assign these Terms at any time without restriction and without notice to you.
15.6 Force Majeure
Pliant shall not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government actions, power failures, internet disruptions, or third-party service outages.
